House Bill 440
House Bill 440 of 2020 (Act 83) provides for the automatic expungement of criminal history records for anyone who has received a full acquittal by the Court. In addition, this legislation provides for automatic sealing for anyone who has recieved a pardon from the Governor. The effective date for this legislation was 12/29/2020; however, it is also worth noting that House Bill 440 provided both the Administrative Office of Pennsylvania Courts (AOPC) and the Pennsylvania State Police (PSP) with up to one (1) calendar year from the effective date (12/29/2021) to commence with the automatic expungement and sealing process.
If you are not inclined to wait for the automatic expungement and sealing process to run its course, you are still permitted to pursue the expungement process on your own and at your expense.
